Gift Card Terms & Conditions

These terms and conditions are essential, and we strongly encourage you to thoroughly review them before placing an order for, or utilizing, a Gift Card. We want to ensure you are well-informed about the following specific terms:

“You” means the customer purchasing gift cards from Automotive Superstore Pty. Ltd. 
“Us, we or our” and its other forms means Automotive Superstore Pty. Ltd.

1.       General

1.1   These Gift Card Terms and Conditions are applicable to both physical gift cards and eGift Cards ("Gift Cards") issued by Automotive Superstore Pty Ltd (ACN 164 454 353). Please note that these terms and conditions do not pertain to gift cards issued in conjunction with our third-party partners as part of a promotional campaign. For promotional campaign terms and conditions, kindly refer to our third-party partner's website before ordering or using a Gift Card.

1.2   By purchasing, redeeming, or attempting to redeem a Gift Card, you acknowledge and agree to abide by and adhere to these terms and conditions.

1.3   Physical gift cards can be purchased either in-store or online, while eGift Cards are exclusively available for purchase online. A limit or value per transaction may apply for all online Gift Card purchases.

1.4   Gift Cards are subject to our website’s return and refund policy.

1.5   Each gift card is valid for three (3) years from the date of purchase.

 

2.       Purchases with Your Gift Card

2.1   You may acquire goods from our website, automotivesuperstore.com.au. For online purchases, instructions for entering the Card Number and Access PIN will be provided on our website to complete the purchase.

2.2   Please note that the Gift Card cannot be used:

a.       To settle an in-store or online credit account;

b.       For the purchase of goods or services that we are prohibited by law from providing to you in the relevant location (e.g., age restrictions on weapons and volatile substances that vary by jurisdiction);

c.       To purchase goods or services that contravene our company policy in the relevant location (e.g., spray paint will not be sold to individuals under 18 in certain locations); and

d.       For the acquisition of tyres or any services supplied by outbound partners.

2.3   When you make a purchase using a Gift Card, we will deduct the value of the goods and services purchased with the Gift Card from the remaining card value (i.e., the portion of the Gift Card's initial value that remains unspent at any given time).

2.4   The Gift Card may only be utilized for purchases up to the remaining card value. If your purchase exceeds the remaining card value, you must cover the excess using another payment method.

2.5   After exhausting the remaining card value, the Gift Card should be destroyed. It cannot be reloaded or topped up.

2.6   You can check your card balance and transaction history:

a.       In store at the checkout; and 

b.       On our website, where you will be required to create an account or use your existing account with Automotive Superstore. 

 

3.       No Cash Advances or Exchanges

You are prohibited from:

a.       Obtaining any cash advance with your Gift Card;

b.       Exchanging your Gift Card for cash; or

c.       Swapping your Gift Card for a different brand, denomination, type of Gift Card, or any other form of tender or discount.

 

4.       Faulty or Damaged Gift Card

We will only replace a Gift Card if it can be demonstrated that the card is faulty or damaged as a result of the production process or due to our fault, our related bodies corporate, or our employees, agents, or contractors.

 

5.       Your Responsibility

5.1   You are responsible for the use and safekeeping of your Gift Card. Please treat it as you would as cash. Lost or stolen cards will not be replaced or refunded.

5.2   You are liable for all transactions conducted with your Gift Card, except in cases of fraud or negligence by us, our related bodies corporate, or our employees.

 

6.       Errors and Complaints

6.1   If you suspect an error has occurred regarding your Gift Card, please call 02 8880 987. You will be required to provide the Card Number and Access PIN to our call centre operator.

6.2   Complaints related to goods or services purchased with a Gift Card must be resolved directly with the respective store. Any items purchased with the Gift Card will not subject to return or refund, only store credits as per our Returns and Refunds Policy (this could be found at https://automotivesuperstore.com.au/returns-and-refunds).

 

7.       Privacy and Your Personal Information

By purchasing, redeeming, or attempting to redeem a Gift Card (which includes providing your personal information), you hereby acknowledge that we (and/or our affiliated companies) may collect, utilize, and disclose your personal information as part of the Gift Card transaction process.

 

8.       Changes to These Terms and Conditions

8.1   To the extent permitted by law, we reserve the right to modify any of the terms contained in these terms and conditions at any time, as required by the following circumstances:

a.       To add or remove participating retailers or places where the Gift Card may be redeemed when those retailers or places cease to support the Gift Card;

b.       To add or remove goods or services that may be purchased with the Gift Card as required;

c.       For reasons of system, administrative, or operational necessity to prevent fraud or other unlawful or unacceptable conduct;

d.       To comply with any mandatory contract, law, regulation, statute, or order or judgment of any court, tribunal, or other body having competent jurisdiction; or

e.       Where we, acting reasonably, believe that such changes will not be detrimental to you.

8.2   These amendments will become effective as soon as they are posted on our website.

8.3   By continuing to use a Gift Card after these terms and conditions have been amended, you agree to be bound by the changes.

8.4   We encourage you to periodically review these terms and conditions to stay informed about the terms governing the use of your Gift Card.

 

9.       Force Majeure

To the extent permitted by law, we shall not be held liable, nor be in breach of these terms and conditions, for failing to observe or perform any of our obligations under these terms and conditions due to any reason or cause beyond our reasonable control. Such causes include but are not limited to acts of God, acts of nature, government acts or omissions, strikes or other industrial actions, fires, floods, storms, riots, power shortages or failures, sudden and unexpected system failures or disruptions, war, sabotage, and other acts or omissions of third parties.

 

10.   Severability

Each provision within these terms and conditions is separately binding. If any portion of a provision within these terms and conditions is deemed void, unenforceable, or illegal in a particular jurisdiction, it shall be severed for that jurisdiction. The remainder of the terms and conditions shall remain in full force and effect, and the validity or enforceability of that provision in any other jurisdiction shall not be affected. This clause shall not apply if the severance alters the fundamental nature of these terms and conditions or contravenes public policy.

 

11.   Governing Law

These terms and conditions are governed by the laws of New South Wales, Australia, and shall be interpreted and enforced in accordance with those laws. Each party submits to the non-exclusive jurisdiction of the New South Wales courts.
